Councillors approve 38 Tweed beachside units

Tweed Shire councillors have approved a strata title development application for 38 beachside units at Bogangar – overturning an earlier ruling on 4 August to reject development application DA21/0983.

The development application was seeking approval for a 38-lot strata subdivision at Lot 12 DP 1273396, 41 Tweed Coast Road at Bogangar.

The decision was made at a meeting at Council’s chambers in Tweed Heads following a Section 8.2 determination review request by the proponent.

The development was originally approved by the New South Wales Government in December 2009.

In keeping with usual practice, a development application to strata-title the residential units was brought to Council’s Planning Committee meeting on 4 August, with councillors voting to support the officer’s recommendation to reject this DA.

The DA was originally opposed on parking grounds.

Council agreed to review its decision after a Section 8.2 determination review of the Environmental Planning and Assessment Act was lodged by the proponent on the NSW Planning Portal on 25 August.

Representations were also made by 85 members of the Cabarita Beach Bogangar community calling for approval of the strata title application, with only one submission against the approval.

Following a requirement to provide 14 days’ notice of the review – which concluded on 9 September – an Extraordinary Meeting was held in Tweed Heads.

The development application can be viewed on Council’s DA Tracker, by entering DA number DA21/0983 or the property’s address.
